Although the images offered by HistoryPicks.com are themselves in the public domain or copyright-free, HistoryPicks.com does considerable work to obtain, verify, digitize, enhance, contextualize, and make available the image or artifact. To ensure that we can continue to offer this service at such a low price, we do make certain restrictions on the use of our images, as described below.

Licensing

When you purchase a HistoryPicks.com image you agree to comply with the terms of our Standard Licensing Agreement, as set forth below.  Customized license agreements are offered on a case-by-case basis by contacting our historian.

  1. You may use HistoryPicks.com images on craft projects, for your own web site, in broadcast media, or printed materials, such as books, coffee cups, puzzles, T-shirts, etc., subject to the following limitations:
    • No more than 40 separate HistoryPicks.com images may be used in a single work.
    • No more than 10,000 impressions of any HistoryPicks.com image can be used in the distribution of a particular work in any printed media. For example, no more than 10,000 coffee cups with the same image can be used. To obtain further information and written permission for runs over 10,000 email historian@historypicks.com.
  2. You may not give away, resell, license, or otherwise distribute HistoryPicks.com images or derivative HistoryPicks.com works on a "stand alone" basis (i.e., you may not distribute the HistoryPicks.com images apart from your own printed and electronic materials).
  3. You may not use HistoryPicks.com images in any defamatory, libelous, slanderous, pornographic, or unlawful manner.
  4. You may not remove or disable, or attempt to remove or disable, any watermarks or proprietary notices or markings associated or included with HistoryPicks.com images, CD- ROMs, or pdf books.
  5. HistoryPicks.com images are copyrighted and are proprietary property of HistoryPicks.com. All rights, titles, and interests in and to HistoryPicks.com images remain with HistoryPicks.com and its suppliers.

No Warranties

HistoryPicks.com images are provided “as is” without warranty of any kind. HistoryPicks.com also specifically disclaims all warranties, express or implied, with respect to the images including without limitation any implied warranties of merchantability and fitness for a particular purpose.

Historypicks.com makes every reasonable effort to verify that the images and content that are offered are free of copyright and in the public domain. However, if you feel you own the copyright to one of our images, please e-mail us at historian@historypicks.com and, if warranted, we will remove the image.

Limitations of Liability

In no event shall HistoryPicks.com be liable for any third party claims or any incidental, consequential or special damages arising out of this license or your use or inability to use the historyPicks’ images, even if HistoryPicks.com has been advised of the possibility of such damages. In no event shall HistoryPicks.com liability (whether in tort, contract or otherwise) exceed the fee paid to HistoryPicks.com for use of HistoryPicks.com images.

HistoryPicks.com may terminate the license immediately if you fail to properly comply with its terms and conditions.

This license is intended as a legally binding agreement between you and HistoryPicks.com Its terms state the entire agreement between you and history picks with respect to your use of the history picks images and supersede any prior understanding or agreements to the contrary.

This license is governed by the laws of the state of California without regard to its principles on choice of law, and in any action relating to this license or the HistoryPicks.com images you agree to the jurisdiction and venue of the state and federal courts sitting in California.

Acceptance of History Picks Terms and Conditions

You signify your agreement and acceptance of HistoryPicks.com terms and conditions upon using this web site, and, at our discretion, we reserve the right to add, modify, change, delete, or restructure our policy at any time as required.
